Terms of Service

MAROGA


The Service Terms apply to all offers, quotations, invoices, orders, services, and agreements. The Service Terms also apply to the nature of the relationship that a customer and Maroga develop with each other. This ranges from visiting one of the Maroga websites to using a specific service offered by Maroga.


1. Service Terms

1.1 The version of the Service Terms displayed online applies at the time you browse through Maroga or use any of the services offered by Maroga. The online version of the Service Terms is identical to the Service Terms applicable to the customer at the time of purchasing a product or availing a service from Maroga. When the Service Terms are modified, the version that was online at the time of your purchase of a product or service from Maroga is applicable.


1.2 Maroga grants you a limited, non-sublicensable license to access and use the Services, solely for personal use. Unless explicitly stated herein, nothing in these Terms should be construed as granting a license to intellectual property rights, whether by estoppel, implication, or otherwise. The fundamental principles in these Service Terms urge everyone not to disrupt, modify, alter, reverse-engineer, circumvent, or destroy the website's content, or any other content related to Maroga.


1.3 The customer's Service Terms do not form part of the agreement between Maroga and the client/customer. Unless otherwise agreed and with written consent from Maroga. When one or more parts of these Service Terms are entirely or partially invalidated or canceled, the remaining parts of these Service Terms shall remain in effect.


1.4 Much of the material on Maroga.com is copyrighted and intellectual property. If you wish to use specific material, you need written permission from Maroga or its respective owners. Within Maroga, this material is used for educational purposes.


Specific Definitions in the Service Terms

The Customer: This refers to you when you purchase a product through Maroga or place a custom order with Maroga.
Client: This refers to you when you commission Maroga for the production of a specific card or design.


2. Objective

Maroga is a venture led by Kees van de Werdt, an inventor and researcher with an educational purpose. The information available on the Maroga website is derived from numerous sources, spanning hundreds of years. Maroga aims to make this knowledge more discoverable, visible, and accessible for those interested in Cartography.


3. Agreements and Contracts

3.1 When a customer chooses to request a quotation or contacts Maroga through other means with the intent to place an order with Maroga, both oral and written communications with Maroga are summarized. The customer will receive an email from Maroga or one of its enterprises, outlining the customer's request and the terms and proposal of the agreement by Maroga regarding the specific customer request. The customer will be asked to confirm Maroga's statements and proposal.


3.2 Maroga will commence work for its clients only after receiving written (email) authorization from the client. In practice, this means that you, the customer, must give the "go-ahead" to Maroga or one of its enterprises before they begin working on your project. After this written consent, the right of withdrawal no longer applies (see section 3.6 for more details). Maroga or one of its enterprises has already started work on your project. Feeling uncertain? 3.3 It is possible that your request/order falls outside Maroga's expertise, making it impossible for Maroga to fulfill and execute your request. When this occurs, Maroga will promptly inform you before attempting to start the project.


3.4 It is possible that a specific request/order/desire does not align with Maroga's principles and ethics. In such cases, Maroga will inform the customer as quickly as possible, aiming to save time so that the customer can seek another party that might accommodate the request/order.


3.5 If a customer chooses to cancel or discontinue the service Maroga is performing for the customer, the hours worked will be charged reasonably. The client will then receive the (unfinished) work from Maroga, allowing the client to take it to another party.


3.6 Enterprises, companies, and organizations are requested to contact Maroga through the business contact form, as communication through that specific channel will be the avenue of interaction. From there, it is possible for Maroga and the concerned company to enter into a business agreement.


3.7 Each agreement is made subject to the suspensive condition of sufficient availability of the respective product.


4. Offers and Requests

4.1 Clients can request a quotation via Maroga's website. After the client has requested a quotation, Maroga endeavors to respond to the client within 24 hours. A quotation is always free of charge and imposes no obligations. A quotation is valid for one month. During this time, the client can decide whether they wish to enter into an agreement and working relationship with Maroga. If a month has passed and the quotation has expired, you can simply request a new quotation.


4.2 Prices stated in offers and quotations include VAT for individual customers. There is no additional calculation required. For business clients, prices are exclusive of VAT.


4.3 A quotation is converted into an order when the client provides Maroga with written "ok to go" as described in paragraphs 3.1 and 3.2.


4.4 If a client wishes to expand the scope of the assignment with work that is not described in the quotation and/or included in the agreements, Maroga may adjust the offer in consultation with the client in accordance with paragraphs 3.1 and 3.2. This will be linked to Maroga's hourly rate to cover the additional work financially and maintain a balance between work performed and payment.


5. Offered Products

5.1 If an offer has a limited validity period or is subject to conditions, this is explicitly stated in the offer.


5.2 The offer is non-binding. Maroga is entitled to change and adjust the offer.


5.3 The offer includes a detailed description of the products and/or services offered. The description is sufficiently detailed to enable the visitor/client to have proper access to the offer. Since Maroga uses images, these are a truthful representation of the products and/or services offered. Obvious mistakes or errors in the offer do not bind Maroga.


Note: When viewing content on Maroga, the screen settings of your PC or mobile phone determine the light value in which the content is displayed. As a result, images on your PC screen or mobile phone may be overexposed or underexposed or may display colors slightly differently than they are in reality.


5.4 All images, specifications, and data in the offer are indicative and cannot be the basis for compensation or dissolution of the agreement.


5.5 Product images are a faithful representation of the products offered. Maroga cannot guarantee that the displayed colors exactly match the real colors of the products. Your screen settings on your PC and/or mobile phone influence the display of a product.


6. Prices

6.1 Prices, including VAT, are listed on the website. Prices may change due to fluctuations in material costs, VAT rates, or other circumstances that necessitate price adjustments. Maroga reserves the right to change its prices in accordance with these terms and conditions.


6.2 When a customer purchases a product via Maroga's websites, the customer commits to the price presented at that time and the prevailing Service Terms at that time. Any price changes that occur after a customer has made a purchase will not be charged additionally to the customer. See also paragraph 1.2, 2.1, and 2.2.


6.3 Prices are subject to typographical and typesetting errors. Maroga does not accept liability for the consequences of typographical and typesetting errors. Maroga is not obliged to deliver the product at the incorrect price.


7. Payments

7.1 You have made a payment but are not satisfied with the work. Contact Maroga, and we will review the details and assist in finding an appropriate solution.


7.2 Payments to Maroga are processed by Stripe. Stripe is listed on your purchase receipt. Stripe processes personal data. Curious about Stripe's terms and conditions? Click here to view Stripe's terms and conditions.

7.4 When the assignment is completed, Maroga sends the work/design to the client. Are you satisfied? Then we will send you an invoice or receipt. The price is predetermined in consultation with the client. However, it may be that the client is not entirely satisfied and wants to see minor changes. This is also done in consultation, and any additional costs (hourly rate) may be charged.


7.5 Maroga's payment terms are set at 14 days (2 weeks).


7.6 Maroga expects the client to have the funds to pay for the assignment. Otherwise, it is strongly recommended not to place an order with Maroga. We advocate a cooperative and fair working relationship.


7.7 If you, as a customer, are unable to pay the invoice within the initial payment term, Maroga will send you a reminder after 14 days. This reminder is also valid for 14 days. If the customer cannot pay the invoice after these 14 days, Maroga will attempt to contact you to discuss the invoice and explore further options to complete the ownership transaction.


7.8 After the 14-day valid payment reminder, a second reminder will be sent, also valid for 14 days. After those 14 days, a third reminder will be sent, also valid for 14 days. Maroga does not charge interest on the amount but does charge (if any) the costs of sending the letters. We continue to assume that this is not done with malicious intent.


7.9 If there is evidence of malicious intent or deliberate non-payment where you also refuse, a solution will be sought in collaboration with Maroga. Maroga will reluctantly have to involve a collection agency. Maroga aims to continue to collaborate.


7.10 In the case of paragraph 7.8 and paragraph 7.9, Maroga may decide not to enter into any further collaboration with the client/customer in the future.


8. Conformity and Warranty

8.1 Maroga guarantees that the products and/or services comply with the agreement and that the specifications provided in the offer meet the reasonable requirements of soundness and/or usability on the date of the conclusion of the agreement and in accordance with legal provisions. Maroga cannot guarantee that the product is suitable for uses other than normal use.


8.2 Any warranty provided by the entrepreneur, manufacturer, or importer does not affect the legal rights and claims that the customer can assert against Maroga under the agreement.


8.3 Any defects or incorrectly delivered products must be reported in writing to Lost Gen. within 2 weeks of delivery. The return of the products must be in the original packaging and in new condition.


8.4 Maroga's warranty period corresponds to the manufacturer's warranty period. However, Maroga is never responsible for the ultimate suitability of the products for each individual application by the customer, nor for any advice regarding the use or application of the products.


8.5 The warranty does not apply or expires if:

- The customer has repaired and/or modified the delivered products themselves or had them repaired and/or modified by third parties.
- The delivered products have been exposed to abnormal conditions or otherwise mishandled or used contrary to the entrepreneur's instructions and/or those indicated on the packaging.
- The defect is entirely or partially the result of regulations that the government has or will establish regarding the nature or quality of the materials used.


9. Delivery and Timeframe

9.1 Maroga and the client agree on when the assignment/project must be completed. Rush orders are possible but may incur additional costs.


9.2 It is possible that due to events beyond our control, Maroga may not be able to deliver on time. Maroga will notify the client as soon as possible, and then Lost Gen Company and the client will jointly try to establish a new delivery date.


9.3 When sending designs and/or products, Maroga uses various mail-order companies, including PostNL, DHL Services, or UPS Services. It is also possible that a design/product is personally delivered by someone related to Maroga.


9.4 Delivery time estimates are provided with the products on the website. Generally, it takes 1-7 days for delivery within the Netherlands, Belgium, and Germany. Whenever possible, the customer will receive a tracking code to monitor the shipment.


10. Right of Withdrawal

When Products Are Delivered

10.1 When purchasing a product, the customer has the option to terminate the agreement without providing a reason within 14 days. This withdrawal period begins on the day the product is delivered to the customer or a representative designated by the customer and notified to Maroga in advance.


10.2 During the withdrawal period, the customer will handle the product and its packaging with care. They will only unpack or use the product to the extent necessary to assess whether it meets their wishes. If the customer exercises their right of withdrawal, they shall return the product, along with all accessories provided and in its original condition and packaging, to Maroga in accordance with the instructions provided by Maroga.


10.3 If the customer wishes to exercise their right of withdrawal, they must notify Lost Gen. within 14 days of receiving the product. This can be done via the contact form or by returning the package directly to Maroga's address. The customer may be asked to provide proof of timely return of the goods, such as a proof of shipment. Keep this receipt during the return process.


10.4 If the customer has not indicated their intention to exercise their right of withdrawal after the expiration of the periods mentioned in paragraphs 10.2 and 10.3 and the product has not been sent back to Maroga, the purchase is considered final.


10.5 When services are provided, the customer has the option to terminate the agreement without providing a reason within 14 days, starting on the day of purchase and/or agreement to the terms of the service.


10.6 To exercise the right of withdrawal, the customer should follow Maroga's instructions regarding the return of the product to Maroga.


Additional Costs for Withdrawal

10.7 If the customer exercises their right of withdrawal, the costs of returning the goods are the responsibility of the seller, provided this is done within 14 days of exercising the right of withdrawal.


10.8 If the customer has made a payment, Maroga will refund this amount as soon as possible, but no later than 14 days after withdrawal, provided the product has been received by Maroga. The refund will be made using the same payment method the customer used unless the customer explicitly consents to another payment method.


10.9 If the product is damaged due to careless handling by the customer, the customer will be held liable for the damage to the product. In such a case, Maroga reserves the right not to accept the return of the product. The customer will be informed of this by email or phone, and a refund will not be granted.


10.10 The customer cannot be held liable for any depreciation of the product if Maroga has not provided all legally required information regarding the right of withdrawal before concluding the purchase agreement.


Exclusion of the Right of Withdrawal

10.11 Maroga may exclude the customer's right of withdrawal for certain products. The exclusion of the right of withdrawal only applies if Lost Gen. The entrepreneur has clearly stated this in the offer, at least in a timely manner before the conclusion of the agreement.


10.12 Exclusion of the right of withdrawal applies to the following products:

- Products that have been tailored to the customer's specifications by Maroga.
- Products that are clearly of a personal nature.
- Products that cannot be returned due to their nature.
- Products whose prices are subject to fluctuations in the financial market over which Maroga has no influence.
- Products whose delivery has begun with the explicit consent of the customer after the expiration of the withdrawal period.
- Products where the customer and Maroga have entered into a working relationship as described in section 3.1, section 3.2, and section 3.6 concerning the creation of custom designs for the client.


11. Ownership and Copyright

11.1 Whatever Maroga creates for the client ultimately becomes the property of the client. After all, you've paid for it. It's that simple.


11.2 Graphic designs and/or paintings may be signed by the designer/artist from Maroga. It is also possible that a logo in the form of a sticker or small text is placed on the back of the design. In all cases, the final product is delivered as clean as possible.


11.3 On the Maroga websites, images, graphic designs, logos, texts, and videos from other artists, designers, and authors are published in digital form. It is always mentioned who the original author and owner of the work is by providing a digital link to the author's/owner's website.


11.4 Following section 11.3: it is never allowed to download and/or use any form of content or material that you can find/see/use on the Maroga website for personal or commercial purposes unless expressly stated on the relevant page that this is allowed. This is purely because art and design works of others have also been made visible on the Maroga websites. Maroga has made agreements/arrangements with these specific artists, designers, and authors regarding the publication of their works on the Maroga websites.


12. Liability, Laws, and Regulations

12.1 If you, as the client, provide visual materials, including video, photo, design, or drawing material, you are and remain liable for their content. This is to account for the use of material that is not yours. If you use material that is not yours, you must arrange for the necessary permissions yourself.


12.2 In the event that Maroga receives images from the client in which a real/factual crime has been recorded in a video or photographic manner, appropriate action will be taken.


12.3 Maroga is not liable for any damage caused to software or hardware when using this website or any other website associated with Maroga.


13. Complaints & Procedure

13.1 Complaints about the execution of the agreement must be submitted to Maroga within 7 days, fully and clearly described, after the customer has discovered the defects.


13.2 Complaints submitted to Maroga will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, Maroga will respond within the 14-day period with a message and an indication of when the customer can expect a more detailed response.


13.3 If the complaint cannot be resolved through mutual agreement, a dispute that is eligible for dispute resolution arises.


13.4 Maroga has an educational purpose and aims to make knowledge accessible in an entertaining manner. In case of complaints, Maroga will make efforts to resolve the problem together with you where possible. It is also possible to report complaints via the European ODR platform (http://ec.europa.eu/odr).


13.5 A complaint does not suspend Maroga's obligations unless Maroga indicates otherwise in writing or it is imposed from external sources.


13.6 If a complaint is found to be valid by Maroga, Maroga will replace or repair the products at no cost.


14. Disputes

14.1 Dutch law exclusively applies to agreements between Maroga and the customer/client to whom these service terms and conditions apply, even if the customer/client resides abroad.


14.2 Disputes are settled by the court in the district where Maroga is located.
